Terms of use

These terms govern the use of the Circle mobile app (the "app") and the website digital-ecosystem.cz. By creating an account or using the app you agree to these terms. If you disagree with anything in them, please do not use the app. The processing of personal data is described in the separate Privacy policy.

1. Who operates Circle

The app is operated by a natural person doing business under the Digital Ecosystem brand ("we"). Contact: info@digital-ecosystem.cz.

2. Who may use Circle

• You are at least 13 years old. If you are under 15, you need the consent of a parent or legal guardian to use the app.
• One e-mail address belongs to one account. You provide truthful details when registering and you do not transfer or sell your account.
• You are responsible for your password and for everything that happens from your account. If you suspect that someone else has gained access to it, let us know right away at info@digital-ecosystem.cz and we will secure the account.
• You can have your account deleted at any time; see Account deletion for the procedure.

3. Beta operation

Circle is currently in closed beta testing. This means:

• Features may change, appear and disappear without prior notice.
• Outages may occur and, in exceptional cases, test data may be reset. We will announce a planned reset in the app in advance.
• We do not guarantee uninterrupted availability. The app is provided "as is".
• Feedback from beta testers is essential to us; send ideas and bug reports to the contact e-mail.

4. Your content

• Everything you put into Circle (TrustBits, photos, videos, comments, TrustShots, messages) remains yours.
• So that we can show your content to others, store it and transmit it, you grant us a non-exclusive, royalty-free licence limited to operating the app. The licence ends when the content or the account is deleted.
• You are responsible for having the rights to your content — do not upload other people's photos, music or texts without permission.
• Other users can see your public content, react to it and comment on it within the app. You control who sees your content through the post visibility setting and a private profile.

5. Community rules

Circle is built on trust. The following is therefore prohibited in the app:

• Content that breaks the law, including any sexual content depicting minors — the procedure and standards are described on the Child safety page.
• Hate speech, threats, harassment, bullying and attacks on other users.
• Spam, mass messaging, scams, phishing and links to malicious software.
• Impersonating another person or organisation and misleading fake profiles.
• Publishing other people's personal data without consent (addresses, phone numbers, private messages).
• Circumventing moderation, password guessing, automated accounts and any interference with the operation of the app or its servers.

6. Moderation, Trust Score and sanctions

• Photos and videos are checked both automatically (Digital Eye, directly on the phone) and by hand; content that does not pass is not published.
• Every post and profile can be reported. Reports are reviewed by the app administrator by hand, usually within 48 hours.
• Trust Score expresses how trustworthy an account is. It grows with honest behaviour and drops when the rules are broken; a low score limits visibility.
• If the rules are broken, we may remove content, lower the Trust Score, temporarily suspend the account or permanently ban it. In serious cases without prior warning.
• If you believe we decided wrongly, you can appeal — the procedure is in the section Reporting content and appeals. We review every appeal.

7. Reporting content and appeals

• You can report a post, comment, profile or conversation directly in the app with the Report button, or by e-mail to abuse@digital-ecosystem.cz. State what the report concerns and why.
• Reports are reviewed by the app administrator by hand, usually within 48 hours; suspected child abuse takes priority.
• If we remove content or restrict an account, the affected user receives a statement of reasons for the decision on request.
• You can appeal against a decision within 6 months at info@digital-ecosystem.cz. The same address is the point of contact for users and for authorities.

8. Privacy and encryption

• Direct messages are encrypted between devices; the keys stay on the phone. We do not read the content of messages. Reported conversations are assessed on the basis of a screenshot and the account's behaviour (blocks, Trust Score).
• Account data and posts are stored on our server in the Czech Republic. Details are in the Privacy policy.

9. Shop

The Shop sells cosmetics only: avatar frames, badges, colour themes and chat bubbles. Trust (Trust Score) and post reach cannot be bought. Some items are free. Seasonal limited editions and sets (several items for one price) are sold only for a limited time; purchased items remain yours after the sale ends.

• Payment through Google Play. You see the price including VAT in the Google Play dialog before confirming. The payment is processed by Google; we never see your card or other payment details, we only receive the order identifier and the purchased product.
• What you are buying. A non-exclusive, non-transferable licence to use the item in the Circle app. The item is tied to your Google account; after reinstalling, you restore it with the "Restore purchases" button.
• Immediate delivery and withdrawal. The item is unlocked immediately after payment. By confirming the purchase you agree to the delivery of digital content before the withdrawal period expires and you acknowledge that you thereby lose the right to withdraw from the contract within 14 days (Section 1837(l) of the Czech Civil Code). Refunds are governed by the Google Play rules; in justified cases (the item did not unlock) write to us and we will put it right.
• Beta operation. Purchased items remain yours even after a possible reset of test data, because they are recorded by Google Play. Displaying cosmetics to other users will be added soon.
• Account termination. When an account is deleted or permanently banned for breaching these terms, the licence to the items ends without any right to a refund.
• Circle+. A subscription (monthly or yearly) through Google Play. It renews automatically until you cancel it in your Google Play account; the price including VAT is shown before confirmation and after cancellation it runs until the end of the paid period. Circle+ provides only cosmetics, insights and tools (frames, themes and bubbles from the Shop — badges are bought separately, post statistics, names of viewers on a TrustShot, captions, full upload quality, a custom icon, chat backgrounds), never reach, Trust Score, verification or safety features. Any free trial can be used once per Google Play account.
• Circle Pro. A subscription for creators (monthly or yearly) through Google Play, containing everything in Circle+ plus tools: scheduled posts, up to five links in the profile and more detailed statistics of your own posts. The same renewal and cancellation rules apply as for Circle+. Circle Pro never provides reach, Trust Score, verification, safety features or priority support either.
• Kruhy (Find a group). The feature connects users into a group based on a topic they write about publicly. A group is created as a public post by its founder; the group's thread consists of the comments below it and is therefore public. Members' posts with the group hashtag count towards the challenge. The same rules apply to them as to any other content. The reward for winning a round is one extra Opening, nothing else.
• Circle Opening. Opening a "crate" containing a random cosmetic item for a limited time (3 to 30 days depending on rarity). Openings are not sold and cannot be increased by any subscription: one per day for every user, regardless of Circle+ or Circle Pro. The odds for each rarity are shown in the app before opening. A temporary item disappears once its time is up; purchased Shop items are not affected.

A contract for membership of the Founders' Club can be concluded separately on the website; it is governed by separate terms available on the website.

10. Intellectual property

The app, its name, logo, design and code are our property or are used under licence. You may use the app for your own non-commercial purposes. Without our consent you may not copy, modify or decompile it, or create derivative works from it.

11. Termination

• You can end at any time by requesting deletion of your account. We will remove the data in accordance with the Privacy policy.
• We may suspend or cancel an account if these terms are breached, on the basis of a legal obligation or when the beta operation ends. Where possible, we will let you know in advance.

12. Liability

The app's core features are provided free of charge and, to the extent permitted by law, we are not liable for damage arising from its use, from an outage or from loss of data during the beta operation. Users are responsible for their content. Your consumer rights under Czech law are not affected.

13. Changes to the terms

We may amend these terms, for example when a new feature is added. We will inform you of substantial changes in the app or by e-mail at least 14 days in advance. The date of the last change is always shown at the top of this page. If you disagree with the new version, you can request deletion of your account.

14. Governing law and dispute resolution

These terms are governed by the law of the Czech Republic. We will try to resolve any disputes by agreement. Consumers have the right to turn to the Czech Trade Inspection Authority (Česká obchodní inspekce) as the body for out-of-court resolution of consumer disputes.
